Q: My dependent child started 36 months of COBRA coverage after he reached the age where he no longer qualified as a dependent. I am the covered employee. My dependent has used 12 months of that COBRA so far. I have been offered another job. If I take the other job, will my dependent's length COBRA coverage be reduced because of my resignation? (Is it a second qualifying event that alters and shortens his coverage?) i.e.; Does he just keep the same 36 months of coverage over the same period of time, which he got on the qualifying birthday? Or would the second event, my possible resignation, change his coverage? If my termination reduces his coverage to 18 months, does the 18 months start when the original COBRA plan started (so that he loses 18 months total) or does it start when my termination begins (so he gets 18 months from the date of my resignation plus whatever he has used to that point)?
A: Your child who lost his/her dependent child status is allowed to keep the COBRA continuation for the entire 36 months even if you obtain another job. As long as he does not have any other health insurance, his COBRA will not be affected.
