My husband was on leave, now the employer says he has to go on COBRA

Q: My husband is out on short term disability, he received a letter from his employer stating after 8 weeks, he must pay the insurance premium himself and after 12 weeks he needs to pay cobra. Does this sound correct? I thought cobra was only if you no longer work for that company?

A: An employee can be eligible for COBRA when an event occurs that causes him to lose his group benefits.  Based on the employer's group plan an employee who is on leave of absence and does not return to work after a specific amount of time must be offered COBRA.
