Q: We have a cobra participant who termed 12/1/07. She elected and paid for only December premiums on 2/4/08. She now wants a refund of her December cobra premiums as she now doesn't want the coverage. We told her no however she keeps emailing us threatening an attorney. Does the COBRA law have any stipulations as to refunding cobra premiums to a member?
A:If documentation is showing she has elected COBRA, then she is not entitled to a refund.However, if she had other insurance at the same time and she can provide you written proof of other insurance coverage, the health insurance company must refund her money.
