Q: I need help with HIPAA: When I retired I did not know that I could not get an individual health insurance plan because of my weight. I am now getting my health insurance through the 18 month COBRA insurance from my previous employer. My insurance runs out in February 2008 and I do not turn 65 until December 2008. Therefore I need insurance for 10 months. From what I have been reading, Does this mean that after using up my 18 months of COBRA insurance from my previous employer’s group plan, that I can apply for an individual insurance plan with ANY provider and they have to accept me?
A: HIPPA restricts the way group health plans apply pre-existing conditon limitations to its plan participants. It does not apply to individual health plans.
