Q: My son lost his job and did not pay enough attention to his Cobra options. So he did not elect to have the coverage. He was recently in accidents that caused an ER visit and some outpatient surgery. Is there any option to elect and pay past premiums and get retroactive coverage?
A:COBRA election does have certain time limitations. You have only 60 days to elect COBRA. That is by the 60th day from when the written notice was sent to you or from when your health care coverage has been terminated, whichever event is later. Your employer has up to 45 days to get the letter to you in the mail stating your COBRA rights. COBRA continuation is retro-active, so any claims that occur during the election period will be paid based on the benefits he had prior to electing COBRA.
