The employer did not notify the insurance company that I was eligible for COBRA

Q: Upon resigning, I asked for a COBRA form from my employer. She gave it to me and I tried to fill it out about 2 weeks later. However, when I was calling the insurance to find out exactly where to send it, they said that my employer had not completed a date of resignation for me and therefore I was not eligible for COBRA because -- according to their records -- I was still under my previous insurance. I waited and now I am getting information from my insurance that my coverage ended on a day that was BEFORE my resignation (I had been ill from job-related problems and not receiving a paycheck, but I hadn't resigned yet). The date of my resignation and the date that they say my benefits ended are both over 60 days ago. Am I no longer eligible for COBRA? I tried to sign up, but they wouldn't let me and now it's too late? I don't need the benefits now, because I have new health insurance, but I am getting bills for medical issues that I had during the 60 days following my resignation when I was trying to sign up and was being told that I was still covered and couldn't sign up for COBRA yet.

 

A: You should contact your previous employer to get this resolved. If they failed to notified the COBRA plan administrator within 14 days of your qualifying event they are at fault.  Your employer also should have included the information in your COBRA packet on where to mail the election form and your COBRA premiums.  If your employer does will not help you then you should contact the US Department of Labor at 1-866-487-2365.

    I resiged my position in October, 2007. My husband & I were coverd under my insurance. I was not offered Cobra. My husband was admitted into hospital June 2008 and we have no insurance. Is there anything I can do?
