Q: My spouse is the person whose insurance we used to cover the whole family. He was recently fired and I have determined I am eligible to cover my family using my company's policy. The problem is that I have a preexisting condition that is not covered. I know COBRA will cover it if my insurance won't, but the question is, can we take my husband and kids off of COBRA while I still keep it?

 

A:   The employee does not have to accept COBRA coverage for himself to get his spouse covered under COBRA continuation.
