Q: My spouse is the person whose insurance we used to cover the whole family. He was recently fired and I have determined I am eligible to cover my family using my company's policy. The problem is that I have a preexisting condition that is not covered. I know COBRA will cover it if my insurance won't, but the question is, can we take my husband and kids off of COBRA while I still keep it?
A: The employee does not have to accept COBRA coverage for himself to get his spouse covered under COBRA continuation. The maximum amount of time you can keep COBRA is 18 months.
