Q: My husband was laid off in January and we're currently on COBRA. I started a job in mid-April with benefits that began the first day. This job doesn't look like it is good fit and I may resign shortly. Does my new company have to offer COBRA as of my termination date? Could we decide to stay on my husband's COBRA?
A: As long as you are receiving group benefits and the employer has more than 20 employees they have to offer you COBRA. The length of time you have been employed is not a factor for COBRA eligibility.
