Q:  If employees opt out of the benefit plans do employers still have to list them with a COBRA vendor as new employees and if they terminate do you have to offer them COBRA?

 

A: An employee has to be enrolled in the employer’s group plan prior to the qualifying event to be eligible for COBRA.
