Q:My sister quit her job and when she applied for COBRA coverage they declined her - is that legal? My understanding was they have to cover you for 18 months.
A:COBRA is a federal law.It allows you to keep your group health insurance when a qualifying event occurs that caused you to lose them. You can not be declined for pre-existing health conditions.Employers that have more than 20 employees are subject to the law and must provide the employee continuation of their group plan. If your sister’s employer has less than 20 employees or if they are a non-profit organization they do not have to offer her COBRA.If you believe your sister should have been provided COBRA then you should contact the US Department of Labor at 1-866-487-2365.
