Q:  I have been insured thru Cobra since I retired from my job and have been sending payments to the plan administrator. In June 2008 my statement said I was covered thru July 2008, I am under treatment for cancer and when I went to my appointment I was told I had no coverage. Well it seems my former employer shut down his business and stopped paying for all his employees as well as the payments to the Cobra administrator. I phoned and requested my premium that I paid in May for coverage in June be refunded to me and was told they would send me the money back. Now after several phone calls the Plan Administrator tells me they can not send my premium back because they sent it to my former employer. It was not his money. Do they owe me the money and do I need to contact the "Commissioner of Insurance" to resolve this. I am in California.

A:  You will want to contact either the department of labor (www.dol.gov) or your insurance commissioner to file a complaint to get your money back.  You can try to contact your previous employer to get your refund back.
