Q:  We have an Employee who just became eligible for our Group Health Plan. We sent her application to the Health Care Provider. Following her probationary performance review, we have decided to terminate the employment relationship. Do we need to follow through on the enrollment and then offer COBRA upon termination? Thank you.

 

A:  The COBRA continuation law requires a previous employer to offer a continuation of group benefits when an employee loses coverage.  If an employee was never enrolled on your group insurance plan, you are NOT required to offer a continuation of benefits under the COBRA law. 

You can refer the previous employee to www.cobrainsurance.com and she may be able to find an alternative plan if she likes.
