Q: I moved out of state and now realize I might need Cobra after all to make sure I have retroactively one more month to avoid gaps of over 63 days between Cobra and my new insurance which has no been approved yet. Can I still get it? I did not notify my insurance before hand that I was moving.
A: Under COBRA law, the employer must give you at least 60 days to elect COBRA from the date the election notice was received or from the date you lose the group health benefits which ever is later. You will need to contact your previous employer and request duplicate paperwork mailed to your new address. If your previous employer hired a COBRA plan administrator, you maybe able to sign up by phone or website.
COBRA is a continuation of your employer’s group plan. When you move you do not lose your COBRA rights. The cost of your COBRA should not change. However, if you are limited to specific providers or have an HMO plan, you would not have coverage available when you move out of your current area. You should contact your health insurance company to find out if your benefits will follow you when you move out of state.
