Q:  I am having a problem getting my continuation letter from my previous employer. He does not seem to know what COBRA is or how it works. My insurance coverage has lapsed and I am 6 months pregnant! I have called numerous people about this and I can't seem to get any answers. Can someone please tell me what I need to do?

A:  If the employer that you just left has more than 20 employees, they have to offer you COBRA. It is a continuation of the same benefits you had before. The employer or their COBRA plan administrator is required to provide you with the COBRA paperwork. Your employer has a total of 45 days from the qualifying event to get your COBRA notification to you.  From the date that you get your notification, you have 60 days to elect coverage.

Once you elect COBRA the insurance is retro-active so you do not have a lapse in coverage. While you are waiting for the paper work; you will not have "proof" of insurance. I suggest that you talk with your doctor's office and medical facility to make arrangements so you could still see the doctor during the COBRA election period. They can re-submit the claims or if you pay out of pocket you will be reimbursed once the paperwork has been processed.

If the company has less than 20 employees they are not subject to the federal law and they do not have to offer you a continuation of their group health plan. What you will want to do is contact your state department of insurance to see if there is a state issued mini-COBRA plan that you can take advantage of.
