Q:  I was wondering if I am able to apply for Cobra after I get divorce? I am currently on my husbands health insurance thru his employer but our divorce will be final soon. Can I get Cobra after the divorce thru his employers insurance?

 

A:  Yes, if you are on your husband’s employer’s group health plan before the divorce and they have more than 20 employees you are eligible for COBRA.  Your husband’s employer must provide you with the continuation under COBRA law. You will be able to continue the insurance. 


These events apply to covered spouses and the dependants.

1.  Death of employee.

2.  Divorce or legal separation.

3.  Loss of dependant status, or when a child comes off of employees insurance due to age or school status.

4.  Employee is entitled to Medicare benefits
