Q:Can Cobra be your primary insurance for the following reason? Married couple over 75, spouse actively employed by large company passed away, spouse was offered and accepted Cobra. Neither employee or spouse was on Medicare B at the time of employee's death. Is she entitled to keep Cobra as her primary insurance since he was actively employed at the time of death and at 75 neither employee or spouse had every applied for Medicare (B).
A:Once your over age 65 that makes you eligible for Medicare but you can still be eligible for COBRA as long as they don't become entitled (starts receiving benefits)to Medicare. Once they become entitled to Medicare they are no longer allowed to continue on the employer’s group health plan.You can’t be on both Medicare and COBRA at the same time.In your situation if you are not signed up for Medicare then you should be able to keep COBRA through your spouse’s previous employer.
