Q:  I am currently covered by Cobra under my husband’s previous employer. My husband retired on 12/31/2006 and applied for medicare so I am the only one covered by Cobra. As a dependent, do I qualify for 36 months since he went on Medicare?

A:  If the covered employee already has COBRA continuation and they become entitled to Medicare before the 18 months end, their spouse and dependents can stay on COBRA.   When this happens it is called a 2nd qualifying event.  The spouse or dependents will receive an additional 18 months of COBRA coverage for a total of 36 months.
