Q: I was on compensation, due to an injury at work. Then a lot of us were laid off 2 weeks later. I was released March 30th. They said to hang loose about my insurance, because no one knew if I had to go on cobra yet. (I am covered for my injury) but meanwhile, my husband had a total knee replacement done 3 days ago and soon as I went to fill his prescriptions, the pharmacists said my card won't work. I checked on the net and it shows my insurance was dropped April 8th. I did not receive anything from work about cobra yet. Am I stuck with a hospital bill? It was called in by the hospital weeks back and cleared. Please help me with info. Thanks.
A: If you are working for a company that has more than 20 employee's than it is a federal law that they will have to offer you a continuation of their group health plan. After you have been terminated from the insurance, the employer has up to 45 days to get information to you regarding your COBRA rights. You will then have 60 days to make your elections and make your first premium payment. Once your payment is made and your insurance is in force your coverage is retroactive and will back date so there is no lapse in coverage. So the medical treatment that may have occurred with in that time period will have to be resubmitted to the insurance company for you to be reimbursed.
