Q:My employer laid off a group of employees on Dec 1st of 2008, I like the rest of this group was offered COBRA continuation, I submitted my application and premium check which were cashed by the policy administrator. Subsequently I was accused of erasing documents on my company issued laptop prior to returning it. My ex-employer accused me of gross misconduct and terminated my COBRA coverage. Is this legal even though the alleged actions took place after I was laid off?
A:I would recommend you contact the Department of Labor at 866-444-3272 or visit their website at www.dol.gov and see what they have to say about that situation.
