Q:  I left a company in May and am currently paying for my insurance through Cobra. In Sept. the policy changed and benefits are limited and it is more costly for me. If I were able to find less expensive insurance and did NOT stay with the Cobra plan for less than 18 months, would I be faced with the pre-exist clause with a new company? Somewhere I _thought_ I read that you had to stay with Cobra for the entire 18 months in order to NOT have a pre-exist clause. Which is correct? Thank you.

 

A:  If you were to find another job that offers a group health plan, and you had no lapse in coverage you shouldn’t have any problems with the pre-existing clause.  If you are looking for a policy on your own, pre-existing laws can vary from coverage to coverage.  Your best option is to be covered with no lapse.
