Q:  COBRA election forms were completed and the first check mailed in July 2008. Each month a check was sent to the former employer for the monthly premiums. The checks took from 6-11 days to clear. Today, March 31, 2009 I learned at the doctor's office there was a problem with my insurance, and then took a prescription to CVS to be told my insurance was canceled. Called the previous employer who claims no knowledge. Called Aetna to be informed that the employer canceled my insurance on March 6, 2009 (3 days before the check cleared) and made the cancellation retro active to Jan 31, 2009. Premiums have been paid to the previous employer, the checks deposited in their bank and I keyed an online check payment this morning for the April payment. What action do I need to take while the previous employer investigates the problem? March 3rd I had to see an orthopedist 3/5-6 physical therapy and on 3/9 an MRI. My insurance was accepted, received an EOB for Aetna and just recently received a new card.....what is going on? Thanks

 

A:  Unfortunately, we are not Cobra.  We offer Alternative plans to your Cobra coverage.  If you feel that there has been some mishandling in regards to your Cobra coverage I would recommend contacting the Department of Labor, who overseas the Cobra law.  They may be able to help sort out your situation and inform you of any rights you may have.  The number to reach them directly is 866-444-3272 or you can also visit there website at www.dol.gov
