Q:  My boss owes me 8 weeks of severance pay and I signed up for Cobra and he wants to take it out of my severance check. Can he do that? I have offered to send 6 post dated checks and is he allowed to take out one month for every severance check?

 

A:  What it really comes down to is what you and your boss decide to do when it comes to how it’s going to be paid for.  Can he take the payments from your severance checks, I am sure he can, and can you send him checks, I am sure you can, ultimately its just what you and your boss come to an agreement on in regards to payments.  If you feel that you are not being showed the rights you have in regards to the Cobra law, I would recommend contacting the Department of Labor who oversee the Cobra law at 866-444-3272.
