Q:I recently was involuntarily released from my job therefore losing my health benefits. The problem is the company I worked for had a service contract with a PEO (Professional Employers Organization). Although my benefits didn't end till 4/30/09 my termination date was 4/24/09. It was of my opinion the PEO being our employer on file would be the responsible party for offering the Cobra. However, it happened that the service contract between my employer and the PEO was terminated on 4/30/09. The PEO states that Cobra follows the employer therefore they feel it is the responsibility of the new replacing carrier to offer the cobra since their effective date is the same as what should be the effective date of my cobra. Can you please confirm who is the responsible party under what law should be offering me cobra? Thank you.
A:The previous employer is the one who should offer you the Cobra coverage.The one who offered you benefits while you were working is the one that should be contacting you with information in regards to applying for Cobra.
