Q: Hi, my wife resigned and I hope she will get COBRA from her former employer. Her former insurance was xxxxx Benefit and Pension Funds; it's in the local NY area. I hope she will get COBRA from her former employer, despite than description of her benefits: “We are not an insurance company. We are a not-for-profit organization funded by contributions from employers that are negotiated by the Union in collective bargaining. Employer contributions pay for benefits, not Union dues." If she will move to another state (NC), how she will get COBRA?
A: COBRA is a continuation of an employer's group health plan. The definition of group health plan is: a contract of health insurance made with an employer or other entity that covers their employees, past employees and their families. It includes different types of plans for the provisions of medical care, such as insured arrangements, self-funded arrangements, on-site facilities, and health flexible spending accounts under a cafeteria plan. She may have to check with the employer to see if COBRA is an option. If it is and you need to move the employer is responsible for finding alternate insurance coverage for you in that state.
