Q: My former employer (when faced with the possibility of having to pay for a portion of my COBRA) told me recently that not only did I owe back pay immediately because of their mistake or my COBRA would discontinue, but that they are only keeping me on COBRA "to be nice because of my medical conditions" and that since the company has technically been sold - it was in the process of that while I worked there - that they didn't have to keep me on it. She also said that she would let me know the cost if they change providers IF they allow me to remain on COBRA. Are they allowed to just do that? Give it to me and then take it away at their leisure? They also in March hadn't paid the health insurance bill and I was left without my medications for almost 2 weeks.
A: I wish I could help you more, however do due the fact that it has to do with you and your rights being met, I am going to recommend you to talk with the Department of Labor. They are the ones who actually oversee the Cobra law, they will be able to let you know what rights you have as well as if your previous employer is meeting them, their phone number is 866-444-3272 and www.dol.gov
