Q: I have an employee on Short Term Disability and probably will be starting Long Term Disability within a few weeks. He is on our Health Plan along with his daughter. He has not paid us his portion of the monthly premium and it's very unlikely we'll ever be paid. Can I enroll him in COBRA under the reduction of hours (he's not working at all) qualifying event? Do I need to send him a letter first asking for payment of his premium?
A: To verify his coverage with Cobra and if he is eligible as far as making payments you should talk with your Cobra administrator the one who handles those benefits for you, as well as you can try contacting the Department of Labor. They are who oversee the Cobra law. You can view them at www.dol.gov you should be able to find your answer on the website.
As far as if you want to offer him Cobra, if he meets the requirements you can absolutely let him sign up, however as far as needing to receive a payment first, clarify that with the DOL.
