Q: Hello, I was terminated for Cobra coverage in Jan 2009 for a late payment. I appealed and they reinstated me on May 1, 2009 but they are billing me from January. It was my understanding that if I was terminated; I wasn't covered so why would I have to pay for a time period I wasn't covered for? Do they have a right to do that? I think I should only have to pay starting from May 1. Thank you!
A: To get your Cobra coverage reinstated you have to pay retro-actively to the last day when you had benefits. Which means when you were “terminated” would be your last day which is in January. Technically Cobra does go retroactive as well, so in that time period if something did happen to you, you would have been covered by Cobra when you were reinstated.
