Cobra Premium Reduction for High Income - Which year used for determination?

Q:  The AARA says that you are not eligible for Cobra payment reductions if your gross income exceeds 250,000 if filing jointly. Question: Are they referring to your gross income for 2008 or if you will not gross 250K in 2009. E.g., my income in 2008 was over 250 but drastically less than 250 in 2009.

 

A:  The year would be your 2009 taxes, when you file your taxes for 2009.
