Q:My ex-husband and I are on family cobra coverage. He has stopped paying his half of the premiums. The Fund sent us a notice that our coverage will be terminating due to non-payment. Under COBRA, do I have the right to switch to an individual plan rather than lose coverage? The Plan documents are silent on the issue. If possible, could you please refer me to the relevant portion of the law? Thanks
A:Due to the fact that it is very technically, and I don’t want to give legal advice, I would recommend contacting the Department of Labor at www.dol.gov/COBRA or calling them directly at 866-444-3272 they are the ones who over see the Cobra law.They may be able to give you better insight on what rights you have in regards to your situation.
