Q: I have a situation where I went from full time to part time at my job following a 6 week maternity leave which terminated my medical insurance and I was never offered cobra. I then had to have an emergency appendectomy (which is when/where I learned about cobra). Now I'm stuck with HUGE medical bills and learned that it was to the fault of my employer that I was not covered because she did not offer me cobra coverage. I don't feel that I should be held responsible for these bills considering I was not offered coverage through cobra. It was to the advice from the hospital that I explore my options. I was just wondering what my next step should be? I've been calling 1-866-444-3272 ( a number I got off of the website) for the past three weeks and have yet to be able to contact someone to talk to in my area (which I think is Dallas) I live in Austin TX. I would appreciate any guidance I can receive. Thank you
A: The number you have been calling is the Department of Labor, they are the ones who oversee the Cobra law, you can also view their website and maybe find other contact information at www.dol.gov/COBRA If your company has more than 20 employees and there is still a group health plan in force than Cobra should have been an option to you. From your last day of benefits your employer has 45 days to send you the paperwork, when you receive the paperwork you would elect the coverage and it would go retro-active to your last day of benefits.
