Q:  I was laid off from my position on April 3rd 2009. After 3 months my benefits center had not sent me the proper information for my entitled COBRA package. I pleaded with them on many occasions that I had not yet received the information and while I was on vacation in July I received a phone call from them that they closed my account. The said if I wanted to I would have to appeal to COBRA but that they were done. Frustrates I looked elsewhere for insurance for myself and my daughter. I have since learned that I will have a problem getting fully covered due to the fact that I am on a prescription for headaches. Last month we tried to have both my daughter and I added to my husbands insurance. Now they won't take us because we have had a 3 month gap where we weren't insured. I was then instructed to go back to you. I need to file an appeal in order to apply for my entitled insurance benefits. If someone could please help me out I would really appreciate it.

 

A:  If your rights you feel were not met, you need to speak with the Department of Labor, they are the ones who oversee the Cobra law.  You can visit their website to see what actions you have at www.dol.gov/COBRA or you can call them directly at 866-444-3272.  They may be able to help you with getting an appeal or tell you what steps you need to take to be sure to get your rights of having Cobra available to you.
