Q: Aunt was on COBRA through her company. Company has financial issues and dropped their insurance carrier. Aunt was contacted and left a message that she is no longer covered due to her age? Company then went and signed up with another carrier and is offering coverage to employees. 1: does my aunt have a right to continue COBRA coverage with the initial carrier, 2: or, does she have the right o continue COBRA with the new program, or, 3: does she have no rights? She left the company due to a disability, was not let go due to any misconduct. Please try to answer.
A: I believe that she should be offered the new carriers benefits, there may be a reason why she can’t but to my understanding she should be able to stay on Cobra. I would recommend speaking with her Cobra administrator, the person that sent her that information. As well as you can go to the Department of Labors website, they oversee the Cobra law you can see what rights your Aunt has with her coverage. The website is www.dol.gov/COBRA
