Q:  We elected COBRA in June 2009. I have been told for the second time that our health coverage has been put on hold pending payment. I have paid our premiums monthly on time and Ceridian shows us paid. According to the insurance company, our health insurance was put on pending eligibility since August 1, 2009 because they have not received payment. I have contacted Ceridian, who in turn contacted the ex-employer. The ex-employed assured it would be taken care of in an hour. It was...and then a week later we were put back on "pending payment" status. I am still awaiting a return call from Ceridian. Who else can I contact about this? Can an employer just simply hold on to our money and not pay the bills? Ceridian claims they forward our money to the ex-employer and the ex-employer has to make the payment to the insurance company. I am getting the runaround and do not know what to do. The ex-employer is known for bouncing payroll checks and asking people to take pay cuts for "just a month." In the meanwhile, we have had tests and doctor visits because we though we were insured!!!! What do I do?

A:  I would recommend speaking with the Department of Labor; they oversee the Cobra law and can let you know what is going on with your coverage as well as what rights you have in regards to the coverage.  They can investigate a bit and let you know what you can do, you can reach them at 866-444-3272 or www.dol.gov/COBRA
