Q: On 12/31/09 is the last day of my employment with my company. Our company is closing and relocating out of the country. I was told that my current health benefit will not be available through Cobra for the 2010 calendar year because we no longer have enough employees in 2010 to form a group for this coverage. My question is, will I be able to have Cobra through my current health plan based upon the prior year, or will I have to select another health plan during the open enrollment period this month, 11/2009 for 2010 after my employment has ended?
A: Cobra is a law that allows you to continue your benefits after you have lost a job, if they group health plan is cancelled than Cobra is not an option because there is no longer a group health plan to continue on. It sounds like you most likely are going to have to find an alternative individual plan.
