Q: We had a manager leave her company vehicle, computer, phone, & camera at our office with a letter of resignation in it (just saying she quit). She put the keys in our night drop - did not fill out separation papers (she had another job.) She also deleted everything off of her computer. We are now getting notices that we owe some of our vendor’s money or they will cancel our policies, etc. She now wants to be put on a Cobra plan - can we legally deny her request? Thank you.
A: Due to the technicality of it, I would recommend either contacting the Department of Labor 866-444-3272 or visiting their website at www.dol.gov/COBRA to see if you have to offer it to her. I believe as long as she wasn’t let go due to gross misconduct you may be obligated to offer it to her. Cobra is a law that allows individuals to continue their benefits after they have left a position.
