Q: I have been terminated due job elimination of my job. My wife is on my plan as a dependent. She has Medicare as secondary coverage. She was declared permanently disabled before she was 65. She was transferred to Medicare when she was eligible by Soc Sec. Are we eligible for COBRA Ins continuation and COBRA subsidy?
A: COBRA should be an option to you, and the subsidy is an option to you if you are involuntarily terminated. So Cobra is an option to you as long as you’re Company has more than 20 employees, however for the subsidy, you have to be involuntarily terminated, not eligible for a spouses Insurance or Medicare. So if you elected the Cobra for just you and your wife had just her Medicare than you should be able to receive the reduced Cobra premium, but if your wife was eligible to stay on your coverage and elect Cobra than it’s not subject to the reduction. You would have to talk with your Cobra administrator about this information as well, and they can let you know what your are eligible for.
