Q: My husband & I (spouse) had coverage through his employer and he was recently terminated from his position. I have coverage available through my work but that coverage does not cover a procedure (test) I had planned on having done in a couple of weeks where the coverage I currently held with my husbands employer does. I want to elect COBRA to continue the coverage that covers this procedure, but need to also enroll the both of us in the coverage through my work. Can I have coverage through my work and elect COBRA at the same time?

A:  If the health insurance under the new group health plan has exclusions or limitations for pre-existing conditions of the employee or dependent, then COBRA can continue through the previous employer's group health plan.
