Q: My wife and I are covered under COBRA from my previous employer and are receiving the reduced premium benefit (ARRA). I'm now being offered a position in another company and would like to know if is possible for her to stay under COBRA even if she wasn't the primary beneficiary. If so, would she be able to continue paying the reduced premium? I will take my new employers plan. Thanks!
A: With the COBRA law and you being able to receive the reduced rate in the cost, once you become eligible for other Insurance through a new employer, you are no longer able to receive the reduced rate. Your wife can continue on the Cobra, even though she wasn’t the primary insurance holder, but its no longer going to be at the reduced rate because she is eligible for coverage through your new employer. You can review the new laws for the reduction at www.dol.gov/COBRA
