Q: I just found out that my husband's employer actually terminated our policy 2 days after his termination of employment. We have outstanding medical bills & claims for outpatient surgeries & office visits & dental bills which have occurred during the past few weeks in which we believed that we still had medical coverage through my husband’s employer. When I contacted the personnel responsible for telling me that we would have 45 days of continued coverage after termination of employment, the same rep. gave me a different story & said you will be covered under cobra for 45 days after employment termination. I don't understand this. My husband has labored for this company for over 16 years, this doesn't seem right?
A: Your previous employer has up to 45 days from the last day of work or last day the group benefits ended to send you the COBRA packet. You have an additional 60 days from the day you receive this packet to return the election form. COBRA is a continuation of your employer’s group health policy it will be the same benefits and coverages you had when your husband was employed. During this time period that it takes for you to receive the forms and return the completed election form you have coverage. Your claims that occurred after your husband’s termination date will be covered under COBRA. You will need to re-submit them once the paperwork has been processed.
