Q: Can you tell me if there is a law that gives the insured the opportunity to renew the existing coverage with the same company until Medicare (3 more years), regardless of medical condition and, if so, what are there policies or rules that dictate the price of the policy?

 

A:  When your COBRA continuation ends you may be able to convert your previous employer’s group policy to an individual policy only if the insurance company offers individual policies.  This conversion policy must be offered to you no later than 180 days before your COBRA continuation ends.  The individual policy might not have the same coverage and might cost more than the COBRA continuation.  An insurance company can base the premiums on your sex, age and your past medical history.
