What happens to my COBRA if my employer drops below 20 employees?

Q:  I am going to leave the company that I am with, which currently has 24 employees. If I elect COBRA coverage when I resign, already have it in place and more individuals leave (dropping the total below 20), will that affect the coverage that I have signed up for?

 

A:  At the time of a qualifying event (your last day of work) if there is more than 20 employees then your employer is subject to COBRA law.  As long as your employer keeps the group health policy in force, you can continue on COBRA for up to 18 months
