Q: An Employee's employment terminated on June 30 due to an illness. On July 6 the employee died.  Does company have to offer Cobra to employee for those first 6 days of July even if employee is now deceased?

 

A: If your company has more than 20 employees, you are subject to COBRA laws and are legally obligated to offer COBRA continuation. The employee, spouse and dependents are eligible for 18 months of COBRA continuation for employee termination which is a qualifying event.  On July 6, when the employee died, caused a secondary qualifying event.  The secondary event allows the spouse and dependents an additional 18 months of coverage for a maximum of 36 months.
