Q: I was recently on Cobra after leaving a job (just ended cobra and was on it for a few months). I have also just joined my new employer's medical plan, but realized I will be going back to my old job. Can the "new" employer deny me Cobra once I leave them for having been employed for only a short period of time? Also, will there be a problem being back on Cobra so soon albeit through a different employer?
A: As long as the new employer you are leaving has more than 20 employees and you are enrolled on their group health plan, then they are required under COBRA law to provide you with the continuation of their group policy.The length of time you have been employed with them is not a factor in eligibility.The amount of time between COBRA continuations from different employers is not going to affect your COBRA eligibility.
