Q:   I have an employee who became medicare eligible in December of 05. He terminated in 6/06 and took cobra for one month with his spouse. His spouse is till on cobra by herself. Is it true that she can have 36 months of cobra fron his entiltilement date?

A:  A dependent may become entitled to an 18 month extension for a total of 36 months only if a second qualifying event occurs.  A second qualifying event is the death of the employee, the divorce or legal separation of the employee and their spouse, if the employee becomes entitled to Medicare or a child's loss of dependent status.
