Q: I was laid off from my employer on April 12. I elected to take COBRA for my family. I sent in the paperwork and was waiting for a bill for my first months premium. On July 16th I contacted my previous employer to see why I had not received a premium bill. They mentioned since I did not pay them they cancelled my COBRA policy. They said it was up to me to make payment without a bill or notification of when my premium payment was due. Can they do this?
A: Your past employer or the plan administrator should have sent to you in the mail an election form with an attached COBRA premium payment option. You then have 60 days to make you selections for election and make your first premium payment. The dates should have been stated on the election form. If you have failed to make you selections and mail back your response, you will have forfeited your rights to elect COBRA coverage. Your employer is not responsible for sending you payment coupons or reminding you of your payment due dates. If you are a healthy person, there are Alternative plans available to you at a lower cost.
