Q: My husband had union insurance. He retired and the union wrote me a letter telling me I had insurance until I was 65. That would have been 2 years. Last year they changed the rules and wrote me another letter telling me that my dependent insurance with them would end December 2006. I asked them if I would get COBRA and the union said "no we don't offer cobra and if we did, you wouldn't be able to afford it" So I had to enroll in another plan that costs me $570/mo. for a $5000. I thought it was the law.
A: When a union contract changes and as a result you lost your retiree benefits, you are eligible for COBRA. Under COBRA law, the union must provide you with the continuation of the group policy for up to 18 months. The COBRA continuation may have cost more than what you are paying for now, but by law the union must provide you with the option to continue through COBRA. You can contact the US Department of Labor to file a complaint at 1-866-487-2365.
