Q: I work for a church organization (with benefits) and will begin working for the same church organization, but in a different position (without benefits) at a different location. They say I must resign and re-apply at the new position, but that would make me not qualify for COBRA. my husband and I need health insurance. What can I do to be able to be covered by COBRA?
A: Most employers that do offer group health plans are required to comply with COBRA. Here is a list of those employers who do not have to comply.
1. Government employers (they must comply with a similar law) 2. Churches or church controlled employers 3. Small business with less than 20 employees’
COBRA is the name of a federal law and does not apply to Churches or church controlled employers. COBRA continuation will not be an option for you. We do offer a short term medical policy that may benefit you.
