Employee is retiring, what happens to the spouse's insurance?

Q:  My dad is working right now and has insurance through his employer for himself and my mom. But he is thinking of retiring and will be eligible for Medicare but my mom is not. She is 60 years old and will she qualify for COBRA? And also for how long. 

A:  Once your dad is entitled to Medicare he is no longer allowed to continue on the employer’s group health plan through COBRA. He is not able to have Medicare and COBRA.  However,  his spouse and dependents will still be eligible for COBRA.  On the COBRA election form from the employer it will allow you to continue the coverage for the spouse and dependents for up to a total of 36 months
