Q:I have a client that was covered on the group medical plan as a couple. He was the employee and he died- he and his wife are over 65 and have Medicare part A&B. Is she eligible for COBRA for 36 months as the dependent of the deceased employer or is she not eligible for COBRA since she has Medicare already? - The company employs under 20 lives. Thanks for your help.
A:An employer with less than 20 employees is not subject under COBRA federal law and do not have to offer the continuation of the group plan. If she is entitled to Medicare she is also not eligible for COBRA. What you will want to do is contact your state departmentof insurance to see if there is a state issued mini-COBRA plan that you can take advantage of.
