Q:  I recently added my newborn son to my COBRA insurance policy. After speaking to a representative they informed me that under COBRA the additional premium amount for my son does not get prorated to the date of his birth. So I have to pay the full price of the premium for my son who was born on the 22nd of the month. That is 21 days I'm paying for that he wasn't even born. I asked for documentation that states I must pay the full months premium but they could not give it to me. I don't feel as if they satisfied my inquiry as to why I'm being charged for the whole month. I had already paid my monthly premium in full. Any information you can give me would be appreciated. I'm basically asking if it's COBRA that mandates when a newborn is added to the policy that the entire month be paid instead of prorated to the birth date, or if I'm getting taken advantage of by this company. Thank you in advance for your help.

A:  COBRA is the name of a Federal law. That law allows you to continue the same insurance that you had. It would be the group health insurance that you have and or the employer who decides when premiums are paid. You may want to question either or both parties. If you still have questions, you may want to contact your state insurance commissioner for advice on the laws of that type of insurance. You can visit the web site at www.naic.org to get information from your state insurance department.
